PROBATE FAQ

General Information

In order to probate (put to record) a will and to qualify an executor or administrator of a decedent's estate, you must appear in the Circuit Court Clerk's Office in the County in which the decedent resided at the time of death. Probate matters are normally handled by appointment.  Walk-ins are ok if the Clerk is available. Appointments generally last approximately 30 to 45 minutes.

Scheduling a Probate Appointment

 Please call the Clerk’s Office at (804) 469-4540 and ask for the Clerk of Circuit Court, John Barrett Chappell, Jr.  When you call you should have the death certificate and will available if there is one.  The Clerk will ask you a few questions pertaining to these documents. 

Please print and bring the following documents.  Depending all the type of qualification not all documents are necessary.  The Clerk should inform you of the necessary documents.
