PETITION FOR RESTORATION OF DRIVING PRIVILEGE
You must be eligible to file a Petition for Restoration or Restricted License. To determine if you are eligible to file for restoration or restricted license, please refer to your Division of Motor Vehicles Transcript.
Instructions and Procedure for Filling for Restoration of Driving Privilege
- Complete the appropriate petition and order setting forth the legal basis for Restoration or Restricted Operator’s license and pay the filing fees of $84 and $24 service fees.
- If you are a habitual offender, but you have not been convicted of a Third Offense Driving While Intoxicated:

- If you are NOT an habitual offender but have been convicted of a Third Offense Driving While Intoxicated:
2. The Court will give you a hearing date. The hearing is always set on the Court’s Misdemeanor Appeals day.
- Misdemeanor Appeals day is the 4th Wednesday of odd number months
3. Service will be on the Commonwealth and DMV.
- DMW will forward a copy of you Driving Record to the Court and the Commonwealth Attorney
4. An order of evaluation at ASAP will be entered if you have ever been convicted of a DUI.
- Once the order for evaluation it has been entered a copy will be mailed to you and ASAP. It is your responsibility to contact ASAP to set up the evaluation

- After the evaluation, ASAP will send the court their recommendation
5. On the hearing date that was giving to you a Order will be entered granting or denying your petition
- Depending on the day and time it could take up to 2 weeks for the Judge to sign the order.

HOW DO I DETERMINE IF I AM ELIGIBLE TO FILE FOR RESTORATION?
To determine if you are eligible to file a Petition for Restoration or Restricted License you must obtain a transcript of your driving record from the Division of Motor Vehicles.

A VASAP evaluation must be obtained for any person seeking Restoration or a Restricted license if any of the convictions on your driving transcript which led to the suspension of your license were alcohol related in accordance with §46.2-360(1) and §46.2-391 of the Code of Virginia, as amended.

WHERE DO I FILE MY PETITION FOR RESTORATION?
If DMV determined you a habitual offender, you must petition the Virginia Circuit Court in the city or county where you currently reside. Out-of-state residents must petition the Circuit Court of the City of Richmond, Virginia.
If you were adjudicated a habitual offender by a Virginia court, you may file your petition in the Virginia court where you were adjudicated a habitual offender or in the Virginia Circuit Court in the city or county where you currently reside. Virginia residents who have been adjudicated a Habitual Offender by a Virginia court; however, currently reside out-of-state must petition the Virginia court that handled the adjudication.
